About these terms
These terms are an agreement between you and Plandalf Pty Ltd (ABN 34 669 535 059) ("Plandalf", "we", "us"). By creating an account or using Plandalf, you agree to them. If you use Plandalf for a business, you agree on its behalf and confirm you are allowed to.
Nothing in these terms takes away rights you have under the Australian Consumer Law that cannot be excluded.
What Plandalf does
Plandalf lets you build checkouts, run promotions, automate what happens after a sale and manage affiliates, on your own website or on pages we host. Payments are taken by your own Stripe or PayPal account, not by Plandalf.
Your account
- You must be 18 or older and give us accurate details
- Keep your password safe. You are responsible for what happens under your account, including what your team members do
- Tell us straight away at hello@plandalf.com if you think someone has got into your account
Free trial
New accounts start with a free trial. You do not need a card to start one. When the trial ends, you choose a plan to keep using Plandalf.
Fees and billing
- Plans and add-ons are billed in advance, monthly or yearly, and renew automatically until you cancel
- Prices are on our website and shown before you pay. We will give you at least 30 days' notice of a price change, and it applies from your next renewal
- Plandalf is not currently registered for GST. If that changes, we will show any GST on your invoices
- If a payment fails, we will try again and let you know. If it keeps failing, we may pause your account until it is paid
Affiliate plan limits
- Plans with a partner sales limit count sales credited to your partners
- Sales through your own link do not count toward that limit
- Your own link is for your own promotion only
- Sales through your own link that someone else promotes count as partner sales
Cancelling and refunds
- You can cancel at any time in your account settings. Your plan keeps working until the end of the period you have paid for, and it will not renew
- If you are not happy with Plandalf, you can ask for a full refund of your first payment within 30 days of it
- After that, we do not refund part-used periods, except where the law requires it
This does not limit your rights under the Australian Consumer Law, including a refund where something we provide has a major failure.
Selling with Plandalf
When you sell through a Plandalf checkout, the sale is between you and your buyer. You are responsible for:
- What you sell, how you describe it, and delivering it
- Your prices, taxes, refunds and chargebacks
- Your own terms and privacy policy for your buyers, and the consent you need from them, for example before sending them marketing emails
- Following the rules of Stripe, PayPal and any other service you connect
Plandalf is not a party to your sales and does not hold your money.
Fair use
Do not use Plandalf to:
- Sell anything illegal, or anything Stripe or PayPal do not allow
- Mislead or defraud buyers, or send spam
- Break into, overload or disrupt Plandalf, or try to get around its security
- Copy, scrape or reverse engineer Plandalf
- Infringe anyone's rights or collect personal information you are not allowed to
Your content and data
You own what you put into Plandalf: your checkouts, content, products and your buyers' details. You give us permission to use it only to run Plandalf for you.
We look after your buyers' details on your behalf, as described in our privacy policy, and we do not use them for our own purposes.
Our software
Plandalf, including its design, templates and code, belongs to us. You can use it while your account is active. If you send us feedback or ideas, we may use them without owing you anything.
Other services
Plandalf connects to services run by others, such as Stripe, PayPal and email platforms. Their terms apply to your use of them, and we are not responsible for what they do.
Changes
We keep improving Plandalf, so features change. If we change these terms in a way that matters to you, we will tell you by email or in the app at least 30 days before the change takes effect. If you do not agree, you can cancel before then.
Suspension and closing accounts
We may suspend or close an account that breaks these terms, puts other people at risk, or has an unpaid balance. Where we can, we will warn you first and give you a chance to fix it.
When an account closes, you can ask us for a copy of your data for 30 days. After that we may delete it, except what we must keep by law.
Liability
Plandalf is provided as it is. We work hard to keep it running and accurate, but we cannot promise it will always be available or free of errors.
To the extent the law allows, we are not liable for indirect losses such as lost profits, lost sales or lost data, and our total liability to you is limited to the fees you paid us in the 12 months before the claim. Where the Australian Consumer Law applies, our liability for failing to meet a consumer guarantee is limited, where the law allows, to supplying the service again or paying for it to be supplied again.
Your responsibility to us
If someone makes a claim against us because of what you sell, how you use Plandalf or a breach of these terms, you agree to cover our reasonable costs of dealing with it.
Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
